These Terms of Service ("Terms") govern your use of the Foretellr platform and services. By accessing or using Foretellr, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not use our services.

Service Description: Foretellr is a digital experimentation platform that enables businesses to design, run, and analyze A/B tests and feature rollouts on their websites and applications. Our platform provides tools for experiment creation, audience targeting, statistical analysis, and result measurement. The Foretellr SDK is a lightweight JavaScript library that customers deploy on their sites to run experiments and collect visitor event data.

Accounts and Eligibility: To use Foretellr, you must be at least 18 years old and capable of entering into a binding contract. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to promptly update any information that changes. You are responsible for all activities conducted through your account, whether or not you authorized them.

Workspaces and Roles: Foretellr organizes access through Workspaces. Each Workspace has an Owner (who manages billing and team members), Admins (who manage integrations and team settings), Editors (who can create and run experiments), and Viewers (who have read-only access). You are responsible for ensuring that only authorized individuals have access to your Workspace.

Acceptable Use: You agree not to use Foretellr for any unlawful purpose or in any way that violates applicable laws or regulations. Specifically, you may not: (a) use Foretellr to conduct experiments that are deceptive, manipulative, or designed to deceive visitors, including dark patterns that exploit cognitive biases or accessibility vulnerabilities; (b) use our service to test content that infringes on the intellectual property rights of others; (c) interfere with or disrupt the integrity or performance of our platform or third-party systems; or (d) use automated tools to access or scrape our services without authorization. You are solely responsible for ensuring that any experiments you run comply with all applicable laws, regulations, and industry standards in your jurisdiction. You are responsible for providing appropriate disclosures and obtaining necessary consents from visitors to your sites regarding data collection and experimentation.

Customer Data and the SDK: When you deploy the Foretellr SDK on your website or application, you represent and warrant that: (a) you own or have the legal right to deploy software on the sites where you use the SDK; (b) you have obtained all necessary consent and made all necessary disclosures to your visitors regarding the collection of visitor data for experimentation purposes; and (c) your use of the SDK complies with all applicable laws, regulations, and the terms of service of any platform on which your site is hosted. We will process visitor data only as directed by you and solely for the purpose of running and measuring the experiments you have configured.

Plans and Billing: Foretellr offers several subscription plans: Free (5,000 Monthly Tracked Users per month, included features), Starter ($49/month for 50,000 MTUs, soft cap with $10/1k MTU overage), Pro ($129/month for 500,000 MTUs with $5/1k MTU overage), and Business ($379/month for unlimited MTUs). Monthly Tracked Users (MTUs) are counted based on unique visitors who generate at least one impression or event in a given month. Billing is workspace-scoped: each Workspace has its own plan and usage limits, and only the Workspace Owner can manage billing and view invoices.

Billing is handled through LemonSqueezy. By providing payment information or authorizing a charge, you agree to be bound by LemonSqueezy's terms of service. We do not store your credit card information; payment data is processed securely by LemonSqueezy. Charges are billed monthly on the date your subscription begins.

Upgrades and Downgrades: You may upgrade or downgrade your plan at any time. Upgrades take effect immediately and are billed pro-rata based on the remaining time in your current billing cycle. Downgrades take effect at the start of your next billing cycle. We do not offer refunds for downgrades or pro-rated refunds if you downgrade partway through a billing period.

Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing cycle, and your services will continue until that date. After cancellation, you will revert to the Free plan (if eligible) or lose access to our services on the next billing date.

Free Tier Limits: The Free plan includes: up to 5,000 Monthly Tracked Users per month; one active experiment; basic audience targeting; and core statistical features. If you exceed 5,000 MTUs in a month, tracking stops and event data is not recorded until the next month.

Availability and Support: Foretellr is provided "as-is" and "as available." For Free and Starter plans, we make no uptime or availability guarantees. For Pro and Business plans, we provide support on a best-effort basis but do not guarantee any specific uptime SLA. We reserve the right to perform maintenance and make updates that may temporarily interrupt service.

Intellectual Property: Foretellr and all content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by Foretellr, its licensors, or other providers of such material and are protected by international copyright, trademark, and other intellectual property laws. You retain all rights to your data and experiment configurations. We grant you a limited, non-exclusive, non-transferable license to use Foretellr solely for your lawful business purposes.

Confidentiality: You agree to maintain the confidentiality of your account credentials and not to disclose them to third parties. We agree to maintain the confidentiality of your data, subject to this Privacy Policy and applicable law.

Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FORETELLR, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE FORETELLR, EVEN IF FORETELLR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF FORETELLR SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO FORETELLR IN THE 12 MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Termination: We may terminate or suspend your account immediately, without prior notice or liability, for conduct that we believe violates these Terms or is otherwise harmful to Foretellr, our users, or third parties. Upon termination, your right to use Foretellr ceases immediately, but your payment obligations continue through the end of your current billing period.

Governing Law: These Terms are governed by and construed in accordance with the laws of [to be completed by the owner], without regard to its conflict of law provisions. You agree to submit to the jurisdiction and venue of the courts located in [to be completed by the owner].

Changes to These Terms: We may update these Terms from time to time. Material changes will be notified by email or through our website. Your continued use of Foretellr following changes constitutes your acceptance of the new Terms.
